NADD Release/Waiver

This Release and Waiver is intended to shift the risk of participating in an event to the Participant/Owner/Guardian of the dog in the event. Do not sign it unless you are willing to accept assumption of the risk of participation and the risk of bodily injury, death, or property damage while at a NADD event while upon the hosting facility's property, club event, in your own home or public space. I fully understand the participation in the sport of dock diving involves risks and dangers of serious injury. These risks and dangers may be caused by my own actions, or inactions, the actions or inactions of others participating. There may be other risks either not known to me or not readily foreseeable at this time AND I fully accept and assume all such risks and all responsibility for losses, costs, and damages.

I certify that I am the actual owner of the dog, or that I am the duly authorized agent of the actual owner whose name I have entered above. In consideration of the acceptance of this entry, I (we) agree to abide by the NADD rules and regulations in effect at the time of this event, and any additional rules and regulations appearing in the premium list of this event and entry form and any decision made in accord with them. I (we) agree that the club/facility holding this event has the right to refuse this entry for cause which the club/facility shall deem sufficient. In consideration of the acceptance of this entry and of the holding of this event and of the opportunity to have the dog judged and to win prizes, ribbons, or trophies, I (we) agree to hold NADD, the event-giving club/facility, AKC, their members, directors, governors, officers, agents, superintendents or event secretary and the owner and/or lessor of the premises and any provider of services that are necessary to hold this event and any employees or volunteers of the aforementioned parties, and any NADD approved judge, judging at this event, harmless from any claim for loss or injury which may be alleged to have been caused directly or indirectly to any person or thing by the act of this dog while in or about the event premises or grounds or near any entrance thereto, and I (we) personally assume all responsibility and liability for any such claim; and I (we) further agree to hold the aforementioned parties harm-less from any claim for loss, injury or damage to this dog. Additionally, I (we) hereby assume the sole responsibility for and agree to indemnify, defend and save the aforementioned parties harmless from any and all loss and expense (including legal fees) by reason of the liability imposed by law upon any of the aforementioned parties for damage because of bodily injuries, including death at any time resulting therefrom, sustained by any person or persons, including myself (ourselves), or on account of damage to property, arising out of or in consequence of my (our) participation in this event, however such, injuries, death or property damage may be caused, and whether or not the same may have been caused or may be alleged to have been caused by the negligence of the aforementioned parties or any of their employees, agents, or any other persons. I (we) agree that any cause of action, controversy or claim arising out of or related to the entry, exhibition or attendance at the event between NADD/AKC/CKC and the event – club/facility and myself (ourselves) or as to the construction, interpretation and effect of this agreement shall be settled by arbitration pursuant to the applicable rules of The American Arbitration Association.

I hereby irrevocably permits, authorizes, grants, and licenses NADD, AKC, CKC, Sponsors, Facilities, Clubs, and its affiliated companies, representatives, agents, sponsors, and assigns the rights to display, publicly perform, exhibit, transmit, broadcast, reproduce, record, photograph, digitize, modify, alter, edit, adapt, create derivative works, exploit, sell, rent, license, otherwise use, and permit others to use photographs, portraits, pictures, electronic or digital images, tape, film, video footage, television, and all reproductions thereof of any and all NADD events (the "Materials") in perpetuity throughout the universe in any medium or format whatsoever now existing or hereafter created, including but not limited to, television and streaming services, without further consent from or royalty, payment, or other compensation to me. I agree that all Materials used by the above are owned by the above, that all above are the owners of all copyrights in same, and that all above shall, in its own discretion, license the Materials without my consent or knowledge. I acknowledges that I have no right or interest in the Materials, nor any right to nor any interest in any copyright therein. I hereby agree that all above shall have the exclusive right to film for broadcast all NADD events and any NADD promotions for the sport of dock diving to a national audience through AKC.tv and broadcast networks.

Scores & Titles are officially property of NADD and cannot legally be used for monetary gain by any other organizations. If you share your scores with any other organization that uses them for their own financial gain and benefit, this may cause your scores, titles, rankings, and other future benefits to be forfeited by NADD.

If any portion of this release from liability shall be deemed by a Court of competent jurisdiction to be invalid, then the remainder of this release from liability shall remain in full force and effect and the offending provision or provisions severed here from. The parties agree that venue for any claim and controversy arising out of this Agreement shall be in the State, District and County Courts located in Ellis County, Texas.

NADD is not responsible for any errors on the entry form nor are we responsible for any errors made by the exhibitor using this entry form when entering events/classes and such errors could have their wins/points/scores invalidated if the dog competes in the wrong class.

I confirm that I have read, understand and agree to the above release/waiver and I will abide by all the current Official NAD D Rules and Regulations (www.northamericadivingdogs.com) and the hosting Facility's/Club’s Rules & Regulations. I hereby Agree that this is my legal & binding typed signature. I am the owner or agent/handler duly authorized to make this entry
